The Federal High Court in Abuja has fixed October 26, 2026, to rule on a no-case submission filed by former Kaduna State Governor, Nasir El-Rufai, in the alleged phone-tapping case.
Justice Joyce Abdulmalik set the date after hearing arguments from El-Rufai’s defence team and the Department of State Services (DSS), which opposed the application.
DSS Presents Evidence Against El-Rufai
During the proceedings, DSS counsel, Oluwole Aladedoye, called two witnesses in support of the prosecution’s case.
The witnesses included a DSS operative and legal practitioner, Deji Adeyanju. They gave evidence concerning an alleged admission made by El-Rufai during a national television interview.
According to the prosecution, the alleged admission relates to the tapping of phone lines belonging to the National Security Adviser, Nuhu Ribadu.
The DSS also linked the alleged phone tapping to a possible breach of national security.
The El-Rufai wire tapping case centres on allegations that phone communications involving the NSA were intercepted.
Defence Seeks Dismissal of Case
El-Rufai’s lawyer, while presenting the no-case submission, urged the court to rule that the prosecution had not presented sufficient evidence to require the former governor to open a defence.
The defence argued that the evidence presented by the prosecution did not establish a case against El-Rufai that required him to respond.
However, the DSS urged the court to reject the application and direct El-Rufai to enter his defence.
Aladedoye adopted the DSS response to the no-case submission and argued that the defence had not adequately addressed Exhibit B.
The prosecution said Exhibit B contained what it described as El-Rufai’s alleged admission regarding the tapping of Ribadu’s phone.
Court Sets October 26 for Ruling
After listening to arguments from both sides, Justice Abdulmalik reserved judgment on the no-case application.
The court will deliver its ruling on October 26, 2026, in the El-Rufai wire tapping case.
The ruling will determine whether the former Kaduna governor will be required to proceed with his defence in the matter.
